These Terms of Service (“Terms”) govern your access to and use of the IRL Mahjong software, websites, mobile applications, and related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy (collectively, the “Agreement”). IRL Mahjong may modify these Terms as described in Section 17. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

2. Description of Service

IRL Mahjong provides a companion application for mahjong, including:

  • Score tracking for in-person games
  • Digital gameplay dealt and run within the app
  • Live scoreboards viewable in a web browser
  • Game history and player statistics
  • Social features such as friends and game invitations
  • Mobile applications for iOS and Android

IRL Mahjong may modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. Eligibility, Registration, and Account Security

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

Portions of the Service may be used without an account. If you register for an account, you agree to:

  • Provide accurate, complete registration information
  • Maintain the security of your credentials
  • Be responsible for all activities under your account
  • Notify IRL Mahjong promptly of any unauthorized access

You may not share credentials, transfer accounts, or use another person’s account without permission. Usernames are visible to other users; you may not choose a username that impersonates another person, infringes the rights of others, or is unlawful or offensive, and IRL Mahjong may reclaim or change usernames that violate this section.

4. License Grant and Restrictions

4.1 License Grant: Subject to these Terms, IRL Mahjong grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its software solely for your personal, non-commercial use.

4.2 Restrictions: You may not:

  • Copy, modify, distribute, or create derivative works from the Service
  • Reverse engineer, decompile, disassemble, or attempt to extract source code or bundled models, except to the extent applicable law permits it despite this restriction
  • Sublicense, resell, or rent the Service to third parties
  • Circumvent any security or usage limits
  • Access the Service to build a competitive product or service
  • Remove proprietary notices or trademarks

5. Acceptable Use

You agree not to use the Service to:

  • Violate any law or third-party rights
  • Upload or transmit malware or malicious code
  • Interfere with or disrupt the Service or its infrastructure
  • Access the Service using automated systems without authorization
  • Impersonate any person or misrepresent affiliation
  • Collect or store personal data of others without consent
  • Harass, abuse, or harm others
  • Cheat, exploit defects, or tamper with scores or game state

Violation of this section may result in immediate suspension or termination of your account.

6. Fees and Payment

The Service is currently provided free of charge. IRL Mahjong may introduce paid features or subscriptions in the future. If we do, pricing and payment terms will be clearly communicated before you incur any charge, and these Terms will be updated accordingly. We reserve the right to change what is offered for free at any time.

7. User Content and Data

7.1 Your Content: You retain ownership of the content you submit to the Service, such as your username, profile image, and support communications (“User Content”). You grant IRL Mahjong a worldwide, royalty-free license to host, store, process, transmit, and display User Content solely to operate and improve the Service.

7.2 Shared Game Data: Scores, results, and game records are shared with the other participants in your games by design, and live scoreboards are visible to anyone with the game link. Game records may persist for other participants, in anonymized form, after you delete your account.

7.3 Privacy: Our collection and use of personal information is described in the Privacy Policy.

8. Third-Party Services

The Service relies on third-party providers for functions such as hosting, data storage, realtime messaging, email delivery, push notification delivery, and optional third-party sign-in. Your use of any third-party service is governed by that provider’s own terms and policies, and IRL Mahjong is not responsible for third-party services it does not control.

9. Mobile Application and App Store Terms

If you download the IRL Mahjong mobile application from the Apple App Store or Google Play, the following additional terms apply:

  • These Terms are concluded between you and IRL Mahjong only, not with Apple Inc. or Google LLC, and IRL Mahjong (not Apple or Google) is solely responsible for the application and its content.
  • Your license to the application is limited to a non-transferable license to use it on devices that you own or control, as permitted by the applicable store’s usage rules.
  • Apple and Google have no obligation to furnish maintenance or support for the application and are not responsible for addressing any claims relating to it, including product liability, regulatory, or intellectual-property claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS application and may enforce these Terms against you.
  • You represent and warrant that you are not located in a country subject to a U.S. government embargo and are not listed on any U.S. government list of prohibited or restricted parties.

10. Service Availability

IRL Mahjong strives to keep the Service available and reliable but does not guarantee uninterrupted availability. The Service may occasionally be unavailable due to maintenance, updates, or network issues beyond IRL Mahjong’s control.

11. Intellectual Property

All intellectual property rights in the Service, including software, designs, models, and trademarks, are owned by IRL Mahjong or its licensors. You obtain no ownership rights under these Terms.

Feedback, suggestions, or feature ideas provided by users may be freely used by IRL Mahjong without obligation or compensation.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IRL MAHJONG DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT SCORING AND TILE RECOGNITION WILL ALWAYS BE ACCURATE. YOU ARE RESPONSIBLE FOR VERIFYING ANY SCORES OR RESULTS THAT MATTER TO YOU.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • IRL MAHJONG SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS OR DATA.
  • IRL MAHJONG’S TOTAL LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF THE FEES PAID BY YOU IN THE 12 MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow limitations of liability, so these limits may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless IRL Mahjong, its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Service
  • Your User Content
  • Your breach of these Terms
  • Your violation of any law or third-party rights

15. Termination and Suspension

IRL Mahjong may suspend or terminate access immediately if you:

  • Breach these Terms
  • Engage in conduct that poses a security or legal risk

You may stop using the Service at any time and may request deletion of your account by contacting support@irlmahjong.com. Upon termination, your license and right to use the Service cease immediately. Sections relating to ownership, disclaimers, limitation of liability, indemnification, and dispute resolution shall survive termination.

16. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict of laws principles.

Before filing any claim, you agree to first contact us at support@irlmahjong.com and attempt to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Washington, and you consent to the jurisdiction of those courts.

You agree to resolve disputes with IRL Mahjong on an individual basis and, to the extent permitted by law, waive participation in any class action or representative proceeding.

17. Modifications and Updates

IRL Mahjong may update these Terms at any time. Material changes will be communicated through the Service or by email, and the updated Terms will be posted on this page with a new “Last Updated” date. Your continued use of the Service after updates take effect constitutes acceptance of the revised Terms.

18. Export Controls and Legal Compliance

You agree to comply with all applicable U.S. and international export laws and sanctions. You may not use or export the Service in violation of applicable export control or sanctions regulations.

19. Miscellaneous

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and IRL Mahjong regarding the Service.

Assignment: You may not assign your rights without IRL Mahjong’s written consent. IRL Mahjong may assign these Terms in connection with a merger, acquisition, or sale of assets.

Severability: If any provision is found unenforceable, the remainder remains in effect.

Waiver: No waiver of a term is a waiver of any other term or of any continuing breach.

Force Majeure: IRL Mahjong is not liable for delays or failures caused by events beyond reasonable control.
